With more employees working remotely, the question has come up about how to adequately comply with required employer posters. Our experts at AleraHR have provided this guidance:

For remote employees, although it is required that information be posted at each physical facility, it is not required that information be posted remotely, at an employee's home as an example.  It is, however, required that the information be communicated to employees.

-       If employees are remote, the posters could possibly be provided electronically.  An employer could post the information electronically on an intranet/ internal site if there is one available and also provide it directly via e-mail, mail, or fax to show a good faith effort to keep all employees informed of their rights.

-       In the absence of an intranet site, information and updates must be sent directly to employees.  A recommended method is to provide a PDF that can be viewed, downloaded, and acknowledged.

-       When posting electronically, employees must be made aware of where the postings are located in the intranet, if applicable, or provided with the changes, and notified anytime an update is made.

-       If information is going to be e-mailed, employees should acknowledge and approve that method of delivery and receipt.

We have a template for an electronic delivery consent form that you may use or adapt.
